About this documentation

A record of an ongoing noise issue

The videos published on this site document noise incidents recorded over approximately the past year and a half. These recordings were made from our property and document occasions when music originating from the Klein property was audible inside our home.

This has been an ongoing issue for our family and has affected our ability to peacefully use and enjoy our home, including a household with young children. During this period, our family has sent two cease-and-desist letters to the Kleins requesting that the disturbance stop. Despite those requests, we have continued to experience and document incidents of music audible from within our home.

This site is maintained as a chronological record of what our family has personally experienced and documented. The videos are provided so viewers can hear and observe the conditions captured at the time of each recording.

Florida nuisance law

Florida courts recognize that neighboring property owners have a common-law duty not to interfere with one another in the use of their property, and Florida appellate courts have recognized that noise can, depending on the facts and circumstances, constitute a nuisance. See Roebuck v. Sills, 306 So. 3d 374, 377 (Fla. 1st DCA 2020), citing earlier Florida nuisance cases.
